<br />ARDEN HILLS PLANNING COMMISSION - APRIL 7, 1999 <br /> <br />~OO~~y <br /> <br />14 <br /> <br />Commissioner Sand asked Staff to indicate on the map where the 100 foot no build area is. Ms. e <br />Randall pointed out the area on the map. Mr. Ringwald stated that the western 50 feet was <br />dedicated to the City, and the eastem 50 feet is an easement. <br /> <br />Chair Erickson closed the public hearing at 9:08 p.m., as no one else wished to address the <br />Planning Commission. <br /> <br />Commissioner Nelson asked if the easement for the road is specific or a general location. Mr. <br />Ringwald stated that the actual location had not yet been determined. Documentation indicating <br />the exact location will be provided to Staff prior to the City Council review. <br /> <br />Commissioner Sand confirmed that each parcel is currently owned, leased, and financed <br />separately. Mr. Sikora stated that the parcels are all under the CSM Corporation umbrella, <br />although they are owned by different entities. <br /> <br />Commissioner Sand asked who the legal owner is according to the legal title of the four parcels. <br />Mr. Sikora stated that the owner is Mr. Gary Holmes, or his heirs. <br /> <br />Commissioner Sand noted that, if the existing building bumt down and there was a separate <br />owner of parcel IV who decided not to rebuild the building, this would negate the benefits of <br />building on parcel ill because the building on parcel IV is needed in order to operate the building <br />on parcel ill. Mr. Sikora stated that it is likely that both buildings would remain with one <br />owner. e <br /> <br />Commissioner Rye moved, seconded by Commissioner Nelson, to recommend approval <br />of Planning Case #99-06, preliminary plat, including variances for a zero building setback <br />where 20 feet is required, zero parking setback where five feet is required, and to allow <br />the use of a private drive rather than a public street, subject to the following conditions: <br /> <br />1. Provision of the required easements for access, parking, sewer, water and utilities <br />between the four parcels. <br /> <br />2. Rice Creek Watershed District approval. <br /> <br />3. Conformance with the conditions of Planning Case 98-24. <br /> <br />Commissioner Nelson stated that he lives west of the property and indicated that the <br />neighborhood appreciates the no-build zone and that the new building is nice looking. <br /> <br />The motion carried (6-1, Commissioner Galatowitsch opposed). <br /> <br />This Planning Case will be reviewed at the Monday, April 26, 1999 City Council meeting. <br /> <br />PLANNING CASE #99-04 - CITY OF ARDEN fiLLS - NEIGHBORHOOD BUSINESS <br />DISTRICT ZONING ORDINANCE AMENDMENT - DISCUSSION ONLY e <br /> <br />Mr. Ringwald explained that Staff is requesting that the Planning Commission commence the <br />review and discussion on the creation of a Neighborhood Business District. <br />
