<br />Page 4 <br /> <br />Deadline for Al!encv Actions .- <br />The City of Arden Hills received the complete application for this (Preliminary Plat) .. <br />request on April 14, 1999. Pursuant to Minnesota State Statue the City must act on this <br />request by Friday, June 11, 1999. (60 days), unless the City provides the petitioner with <br />written reasons for an additional 60 day review period. The additional review period would <br />extend to Tuesday, August 10, 1999. The City may with the petitioner's consent extend the <br />review period beyond the Tuesday, August 10, 1999 date. <br /> <br />Lastly, if the City denies the petitioner's request, "... it must state in writing the reason for <br />the denial at the time that it denies the request." <br /> <br />Options <br />I. Recommend approval as submitted. <br />2. Recommend approval with conditions. <br />3. Recommend denial with reasons for denial. <br />4. Table for additional information. <br /> <br />Recommendation <br />The Planning Commission recommends approval of Planning Case 99-03, preliminary <br />and final pial including the variances for: lot width 80 feet is provided where 85 feet is <br />required for Block 1, Lots 1, 2, and Block 2, Lots 1, 2; be approved, based on the finding <br />of the variance section ofthe Staff report dated May 5, 1999 with the following <br />conditions: <br /> <br />e <br /> <br />1. Title information be submitted to the City for review by the City Attorney. <br />2. Extension of Shoreline Lane through the subject property be deeded to the City. <br />3. Provide staff with proposed grading and sediment and erosion control measures that <br />are proposed to be used on this project for staff approval. <br />4. Payment of appropriate Park Dedication as determined by City Council as provided <br />for by the Subdivision Ordinance in Section 22-9 of the City Code. <br />5. Payment of Escrow for future extension of Shoreline Lane to the north property line. <br />6. Approval by Rice Creek Watershed District. <br />7. Basement elevations not be below 887.8 feet <br />8. Utility and drainage easements be provided per Subdivision Ordinance Section 22-8 <br />(17)(e). <br />9. Construction specifications for street and utilities be submitted with the final plat <br />submittal. <br />10. Easements in a form acceptable to the City Engineer and City Attorney be granted to <br />the City for the temporary cul-de-sac, and the documents be submitted with the final <br />plat application. <br />11. Right-of-way from the south (Rushenberg and Wessland Property) be acquired prior <br />to final plat for access to the property. <br />12. Outstanding fee for attorney fees in the amount of$1,118.80 be paid in full prior to <br />final plat approval. <br /> <br />e <br />
