<br />Chapter 3 Licenses and Regulations <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />, <br />1 <br />I <br />I <br />1 <br />I <br />I <br /> <br />prior to the date of the public hearing to each owner of property located within five <br /> <br /> <br />hundred (500) feet of the premises which are the subject of the application. A copy <br /> <br /> <br />of the notice and a list of the names and addresses of the persons to whom it was sent <br /> <br /> <br />shall be attached thereto by the Administrator and shall be made a part of the records <br /> <br />of the proceedings. The failure to give mail notice to individual property owners shall <br /> <br />not invalidate the proceeding providing a bona fide attempt to comply with this <br /> <br />Subdivision has been made. <br /> <br />2. Public Hearing. The City Council shall conduct a public hearing. The applicant, <br /> <br /> <br />or his or her representative, shall be given the opportUnity to appear before the City <br /> <br /> <br />Council to present reasons why his or her application should be granted and to answer <br /> <br />questions of the councilmembers and members of the public. All persons in favor of, <br /> <br />opposed to, or interested in the application shall be heard, The City Council may <br /> <br />adjourn the public hearing to its next meeting, either regular or special, and may <br /> <br />continue its study and consideration of the application at meetings subsequent to the <br /> <br />meeting at which the public hearing was initially held. <br /> <br /> <br />3. Considerations. The City Council shall consider, in determining whether to grant, <br /> <br /> <br />deny, or renew a license, the effect of the proposed establishment upon the health, <br /> <br /> <br />safety, convenience, morals and general welfare of the Owners and occupants of <br /> <br />surrounding properties in particular and the community as a whole and at a minimum <br /> <br />the following factors: <br /> <br />I <br /> <br />3 - 56 <br />
