<br />f d1.hrf A ~ <br /> <br />. <br /> <br />CITY OF ROSEVILLE <br />ORDINANCE #1215 - SETBACK PERMITS <br /> <br />Section 1013.05. <br /> <br />Procedure for Setback Permit. <br /> <br />A. Purpose. The purpose of the setback permit is to encourage residents to upgrade <br />and improve theif properties, while maintaining the overall character of the <br />community. <br /> <br />B. <br /> <br />Procedure For Setback Permit. An owner ofland may file an application for a <br />setback permit as defined in subsection I below by paying the fee set forth in <br />Section 1014.03 of this Title and providing a completed application and <br />supporting documents as set forth by the Community Development Department. <br />The application shall then be referred to the Development Review Committee as <br />set forth in subsection 2 of this Section. In the event that the Committee and <br />contiguous property owners unanimously recommend approval of said setback <br />permit, the setback permit may be issued by the Community Development <br />Director. In the event the setback permit is not issued by the Community <br />Development Director, or if the applicant does not find the conditions placed on <br />such a permit per subsection 1013.05 (B)(10) acceptable, the applicant may <br />proceed as provided in Section 1013.02 and the original fee shall be applied to the <br />fee as required fOf a variance. <br /> <br />. <br /> <br />1. A "setback permit" is a reduction of the front, side or rear yard setbacks of <br />principal and accessory structures in eithef R-l or R-2 Districts, or to the <br />residential driveway restrictions in subsection 703.04B ofthis Code. <br /> <br />2. The Development Review Committee shall be appointed by the City <br />Manager and shall include the Community Development Difector. For the <br />purpose of setback permit review and recommendation, the Development <br />Review Committee shall be advisory to the Community Development <br />Director. The Community Development Director (or designee) may also <br />fequest review of applications from othef City departments or public <br />agencies. (Current members ofthe Development Review Committee <br />include the Community Development Director, Chief Code Enforcement <br />Officer, Public Works Directof (Of designee), City Managef (or designee), <br />City Planner, Park & Recreation Director ( or designee), Police Chief (or <br />designee), and Fire Marshall) <br /> <br />3. The Community Development Difector ( or designee) shall, in writing, <br />seek comment from contiguous property OWllefS before considering a <br />request for a setback permit. <br /> <br />. <br />
