The applicant is requesting approval of the developers agreement for the final <br />plat (Josephine East) on 2.47 acre parcel zoned R-2 Single Family Residential District <br />(Attachment A). <br /> <br />Background. At the May 31,1999, Regular City Council meeting the applicant was <br />granted Final Plat approval including the variances for: lot width 80 feet where 85 feet is <br />required for Block I, lots 1, 2, Block 2, lots 1, 2; based on the fmdings of the variance <br />section of the Staff report dated May 5,1999 with conditions. <br /> <br />. Updates. The following conditions have not been fully resolved: <br /> <br />Condition 1. Title information be submitted to the City for review by the City <br />Attorney. <br /> <br />The City Attorney has one potential problem with the title relating to an easement from <br />1916. The applicant's attorney is aware of this issue and staff believes this can be <br />resolved prior to the signing of the final plat. This should not hold up the developers <br />agreement. <br /> <br />Condition 9. Construction specifications for street utilities must be approved prior <br />to the final plat being signed by the City and released for recording. <br /> <br />The City Engineer has reviewed the grading plan and construction specifications and <br />requested two modifications as outlined in his August 2, 1999 memo (Attachment B). <br />The developer disagrees with these modifications. Staff has made the changes on the <br />proposed grading plan (Attachment A, Exhibit A) and construction plans (Attachment A, <br />Exhibit B) <br /> <br />e <br /> <br />Staff has added a section to Page 2, Section C of the developers agreement which, states <br />the changes recommended by the City Engineer be incorporated by the Developer into a <br />final draft of Exhibit A and certified by a registered surveyor. <br />
