As part of the Approval, the <br />Developer is not being required to fully improve Shoreline Lane through the <br />entire Property at the present time. In order to assure the availability of funds <br />for the future improvement of Shoreline Lane to the north property line of the <br />Property, the Developer shall deposit with the City the amount of $ 21,750. <br />Said amount shall be in addition to, and may be co-mingled with, the <br />Improvement Escrow funds referred to in Subsection N below. The escrow shall <br />be held by the City until the completion by the Developer of the improvements <br />effecting the extension of Shoreline Lane to the northerly boundary of the plat. <br /> <br />F. Rice Creek Watershed District. The Developer shall provide the staff with the <br />written approval by the Rice Creek Watershed District for the development <br />contemplated by the plat. The approval shall be in a form and substance <br />acceptable to the City Staff. <br /> <br />G. Basement Elevations. The Developer hereby agrees that no structure shall be <br />constructed on the Property with the basement which has an elevation below <br />887,8 feet. This condition, at the option of the City, shall be placed in the form <br />of a recordable instrument recorded/registered against the Property. <br /> <br />Utility and Drainae:e Easements. The Developer shall provide the City with <br />utility and drainage easements, in a form acceptable to the City Staff as required <br />by the City's Ordinance Section 22-8(17)(e) and as shown on the final plat <br />approved May 24, 1999. <br /> <br />I. Construction SDecification for Street and Utilities. The plans and specifications <br />for the streets and utilities for the project are attached hereto as Exhibit B (the <br />"Street/Utility Plans and Specifications"), All streets and util ities for the <br />project must be constructed in accordance with the Street/Utility Plans and <br />Specifications. In addition: <br /> <br />H. <br /> <br />1. <br /> <br />Unusable material within the roadways shall be removed by the <br />Developer; <br /> <br />2. <br /> <br />The City Engineer, as Developer's expense, shall be present, at all times <br />deemed appropriate by the City Engineer during, underground pipe <br />construction and street construction. (This may mean that the City <br />Engineer will be present full time during such activity.) The City <br />Engineer shall be given no less than 24 hours notice of the <br />commencement of any such activity. At all other times, the City Engineer <br />may make periodic visits to the site to insure that the Developer and its <br />contractor are in compliance with the terms of this Agreement. which <br />visits shall be at the expense of the Developer. <br /> <br />3 <br />
