The dimensions of the new garage be the same as or smaller than the <br />existing garage being replaced. <br /> <br />The motion carried unanimously (6-0), <br /> <br />This Planning Case will be reviewed at the Monday, October 25, 1999, City Council meeting, <br /> <br />PLANNING CASE #99-19 - DANIEL TAYLOR -1605 LAKE JOHANNA BOULEVARD- <br />VARIANCE - PUBLIC HEARING <br /> <br />Chair Erickson opened the public hearing at 8:05 p.m. <br /> <br />. <br /> <br />Ms. Randall explained that the applicant was requesting approval of a front yard setback variance <br />(15 feet proposed, when 40 feet is required), There are four homes along Lake Johanna <br />Boulevard that access off a private easement on Ramsey County Property. The applicant owns <br />the first two homes. The applicant was proposing to relocate the single family home on 1605 <br />Lake Johanna Boulevard to 1609 Lake Johanna Boulevard and construct a new single family <br />home on 1605 Lake Johanna Boulevard. Both would require front yard setback variances. <br /> <br />The properties are unique and staff had to determine which side would be considered the front. <br />The Zoning Code states that the shorter side on a corner is the front yard. The three homes to the <br />north clearly do not have a frontage on a public street. However, they access by easement which <br />is the shortest side. Therefore, staff determined that to be the front yard for 1609 Lake Johanna <br />Boulevard. The corner lot at 1605 Lake Johanna Boulevard was more difficult as this property <br />does have rights out to Lake Johanna Boulevard as well as the easement. The easement side is <br />the shortest side and, because of this, staff determined the easement side to be the front yard of <br />this property, Both corners would require a 40 foot setback. <br /> <br />The two homes to the north of these properties currently have variances to build with 20 foot and <br />25 foot setbacks. However, these lots are larger than the lots owned by the applicant. The <br />proposed setbacks would fall in line with the setbacks ofthe properties to the north. <br /> <br />The property at 1609 Lake Johanna Boulevard currently has a basketball court to the rear and the ... <br />property at 1605 Lake Johanna Boulevard has a relatively new pool to the rear. The applicant .. <br />would like to preserve both ofthese amenities. In placing the existing home on 1609 Lake <br />Johanna Boulevard, the applicant found that in order to meet the 40 foot setback from the front, <br />the home would be in the center ofthe lot, which would not provide a backyard.
