Commissioner Sand asked what the minimum side <br />yard setback would be at the northeast comer of this lot. Ms. Randall stated that this would be a <br />minimum 10 foot side yard setback, Commissioner Sand stated that, if the home were moved <br />back to allow at least a 20 foot setback, this would only move the home five feet closer to the <br />basketball court. He felt that the basketball court was a non-issue as this was only a surface <br />amenity. He stated that he was more concerned with what to do with lot 1605. He agreed that it <br />was difficult to grant a variance without a home design. He acknowledged that, if the variance <br />was not granted for lot 1605, the applicant could not proceed with plans for lot 1609. <br /> <br />Mr. Taylor asked if the Planning Commission could grant the variance request from the easement <br />and withhold approval of the fmal plan until building plans are submitted according to what was <br />approved. <br /> <br />Since the home at 1613 Lake Johanna Boulevard was granted a 20 foot setback, Commissioner <br />Rye suggested the applicant consider a 20 foot setback for these properties. With some <br />adjustments to the homes, this would allow these properties to be consistent with the homes at <br />1611 and 1613 Lake Johanna Boulevard. Mr. Taylor agreed that this would be reasonable, <br /> <br />Chair Erickson requested confirmation that the variance request must be either approved or <br />denied as proposed and not changed during the review. Ms. Randall stated that the Planning <br />Commission can modifY the request to what they would be willing to approve. Commissioner . <br />Sand stated that modifYing the request without the applicant's consent would not make sense. <br />Mr. Taylor stated that he would be willing to allow this modification as it would be better than <br />not being approved. <br /> <br />Commissioner Baker reiterated that it was difficult to establish the need for a variance for lot <br />1605 without reviewing the plans for the proposed home. <br /> <br />Chair Erickson stated that he may be willing to support a request for a 20 foot setback since the <br />homes to the north of these properties had set this precedence, He stated that the preexisting <br />conditions of adjacent homes can be considered and it would be reasonable to allow a new home <br />to be built with the same standards of the other homes in the area. Mr. Taylor stated that he <br />would be willing to revise his request to a 20 foot setback. Chair Erickson stated that this would <br />be a reasonable parameter based on what had previously been approved for the other homes. <br /> <br />If the applicant was willing to accept a modified setback variance for both properties to be a <br />minimum of 20 feet at the shortest distance, and comply with all other setback requirements, <br />Commissioner Sand stated he would be willing to support this request. He agreed that the <br />applicant needed some guidance as to where he can place the new home. <br /> <br />Commissioner Sand moved, seconded by Commissioner Duchenes to recommend <br />approval of Planning Case 99-19, front yard setback variance, as modified by the <br />applicant to 20 feet proposed, when 40 feet is required, for placement of two single <br />family homes at 1605 and 1609 Lake Johanna Boulevard, subject to these properties <br />meeting all other side and rear setback requirements.
