<br />I <br /> <br />Deadline for Agency Actions. The City of Arden Hills received the completed a <br />application for this request on November 1,1999. Pursuant to Minnesota State Statute ., <br />the City must act on this request by Thursday, December 30, 1999 (60 days), unless the <br />City provides the petitioner with written reasons for the additional 60 day review period. <br />The additional review period would extend to Monday, February 28, 2000. The City may <br />with the petitioners consent, extend the review period beyond the Monday, February 28, <br />2000 date. <br /> <br />Due to various reasons, some of which include the complexity of the applications <br />received and limited staff time, the December 1,1999 Planning Commission was <br />canceled. The City informed the applicant that an additional 60 days would be needed to <br />process this application. <br /> <br />Lastly if the City denies the petitioners request, ".. .it must state in writing the reasons for <br />the denial at the time that it denies the request." <br /> <br />Recommendations. The Planning Commission recommends approval of Planning Case <br />#00-01, Special Use Permit amendment (updating the Master Plan) and Site Plan Review <br />(for the park facility), conditioned on: <br /> <br />1. Execution of a new Special Use Permit Document 00-01. <br />2. Dedication of a trail easement for the existing trail to be prepared and recorded by the <br />applicant and approval by staff. <br />3. Compliance with the height ordinance for structures. <br />4. Compliance with requirements of the Shoreland Management regulations. <br />5. Rice Creek Watershed District approval. <br />6. Compliance with the Lighting standards of the Zoning Ordinance. <br />7. No lighting be erected for the ball fields and tennis courts. <br />8. Sewer service be extended and the bathrooms be changed to a permanent structure. <br />9. Add six pine trees at a minimum of eight feet tall, at 45 degree angles to each other <br />on the City property, east of the seven pinkspire crabapple trees. <br />10. The parking lot lights be controlled by a timer and be turned off one hour after sunset. <br />11. The applicant provide staff with revised lighting plan for the parking facility <br />providing options for lower lighting, for final review by the City Council. <br />12. Review the turn lane requirements with Ramsey County. <br /> <br />e <br /> <br />Note: Pursuant to Section VIII, D, 3, b of the Zoning Ordinance a "...a special use permit <br />requires a four-fifths (415's) majority vote of the full council and must include a <br />determination that the facts and circumstances of the particular case warrant granting the <br />permit." <br /> <br />At the January 31, 2000, City Council meeting there was some discussion modifying the <br />motion by eliminating condition number 8 and modifying condition number 11 to allow for <br />the lighting plan to consist off our 20-foot poles with a 3-foot footings. <br /> <br />e <br />
