<br />1 <br /> <br />e <br /> <br />CITY OF ARDEN HILLS <br /> <br />MEMORANDUM <br /> <br />TO: <br /> <br /> <br />Mayor and City Council <br /> <br />DATE: <br /> <br />February 14, 2000 <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />Planning Case #00-09, Variance (Corner Side Yard Setback) <br />Howard Bloom, 1720 Glenview Avenue <br /> <br />Request. The applicant is requesting approval of a comer side yard setback variance (24 <br />feet proposed, when 40 feet is required) for a family room addition on a single-family lot <br />zoned R-l (Exhibit A). <br /> <br />e <br /> <br />Background. The proposed addition includes a family room (14 by 16 feet), eating area <br />(15 by 16 feet), and porch (12 by 12 feet) for a total addition of 608 square feet. The <br />applicant has evaluated other locations for the addition; however, this is the only location <br />they feel will work with the existing home. The house currently has a side yard setback <br />of 18 feet, where 40 feet is required. <br /> <br />The existing home is located in an area that was developed when the zoning ordinance <br />allowed for a smaller comer side yard setback after the home was built. <br /> <br />Findings - Corner Side Yard Setback Variance. <br />The Staff would conclude that the following factors relate to the requested variance: <br /> <br />1. Circumstances Unique to the Property: The property in question is 13,750 square feet <br />in area on the comer of De 11 view Avenue and Glenview Avenue. <br /> <br />The proposed addition is 608 square feet in area. When the lot was platted, the <br />required comer side yard setback was less than the 40 foot now required. The <br />existing property meets all the minimum dimensional and area standards except the <br />40 foot required comer side yard setback. <br /> <br />2. Variance would allow a condition that is consistent with the surrounding <br />development: The proposed addition would allow a condition that is consistent with <br />the surrounding development. The parcel was developed under standards different <br />than current regulations would allow. The addition will not alter the essential <br />character ofthe neighborhood. <br /> <br />e <br /> <br />Deadline for Agency Actions. The City of Arden Hills received the completed <br />application for this request on January 3, 2000. Pursuant to Minnesota State Statute, the <br />City must act on this request by Friday, March 3, 2000 (60 days), unless the City <br />provides the petitioner with written reasons for an additional 60-day review period. The <br />additional review period would extend to Tuesday, May 2, 2000. The City may with the <br />petitioners consent, extend the review period beyond the Tuesday, May 2, 2000 date. <br />
