<br />e <br /> <br />. <br /> <br />. <br /> <br />ARDEN HILLS PLANNING COMMISSION - MARCH 1,2000 <br /> <br />DRAt <br /> <br />9 <br /> <br />Commissioner Sand moved to recommend denial of Planning Case #00-14, comer side <br />yard variance for a porch addition so that other design options can be considered and a <br />formal presentation made to the Planning Commission. <br /> <br />Commissioner Sand stated that he thinks trying to redesign the porch configuration tonight may <br />actually result in "hamstringing" the applicant in what he can design and construct. <br /> <br />Commissioner Nelson seconded the motion. <br /> <br />Commissioner Nelson asked if the staff recommendation would provide a benefit. Mr. <br />Mertensotto stated it would allow a front entrance to be constructed which would be of benefit to <br />him. <br /> <br />The motion failed (2 ayes, Erickson and Sand - 2 nays, Nelson and Rye). <br /> <br />Commissioner Nelson moved, seconded by Commissioner Rye to recommend approval <br />of Planning Case #00-14, comer side yard variance for a porch addition based on the <br />"Findings-Comer Side Yard Setback Variance" section of the staff report dated March 1, <br />2000, with the following modification: <br /> <br />1. <br /> <br />Eliminate the 8 by l4-foot section on the northeast side thus only needing a 12- <br />foot setback where a 40 foot setback is required. <br /> <br />The motion carried (3-1 Sand). <br /> <br />This Planning Case will be reviewed at the Monday, March 13, 2000, City Council meeting. <br /> <br />PLANNING CASE #00-15 - ROBERT ALEKSANDER - 4453 OLD HIGHWAY 10- <br />REAR YARD VARIANCE <br /> <br />Ms. Randall explained that the applicant was requesting approval of a rear yard setback variance <br />(23 feet 6 inches proposed when 30 feet is required) for a room and deck addition on a single- <br />family lot zoned R-1. <br /> <br />The proposed porch addition is a 500 square foot addition running along the back side of the <br />home. The home was constructed in 1988 with three patio doors facing out the back of the <br />home. When the home was built, the Zoning Ordinance required a 30-foot rear yard setback <br />which is the same as required today. The home was placed 35 feet 6 inches from the rear <br />property line. <br /> <br />The applicant has stated that due to the interior configuration and location of the existing patio <br />doors, this seems the most feasible location for a deck and room addition. The home currently <br />meets all setback requirements. The lot is very wide, allowing for expansion on either side of the <br />home. The rear of the home borders land owned by the U.S. Fish and Wildlife Service, which <br />surrounds Round Lake. The area between the ordinary high water mark and the rear property <br />line is about 200 feet. Zoning Ordinance Section VI, C, d, requires a 75-foot setback from the <br />ordinary high water mark. The proposed porch and deck meet the 75-foot setback requirement. <br />
