<br />ARDEN HILLS PLANNING COMMISSION - MARCH 1, 2000 <br /> <br />DRAF <br /> <br />12 <br /> <br />Commissioner Sand noted you could generate a six foot deck extension from the living room <br />sliding patio door and fall within the setback requirement and still use the step up to the main -- <br />deck with a slight adjustment and construct the three-season porch on the south side from the .. <br />dining room. <br /> <br />Ms. Randall stated the neighbor to the north called with basic questions and expressed no <br />concern. <br /> <br />Commissioner Nelson stated that due to the U.S. Fish and Wildlife Service area impact and <br />distance to the lake, he is inclined to accept this proposal. <br /> <br />Chair Erickson asked about variances around Karth Lake. Ms. Randall stated property lines <br />around Karth Lake run into the lake. Chair Erickson noted that this type of restriction on the <br />petitioner's property is unique to Arden Hills. Mr. Randall agreed and stated she notified the <br />U.S. Fish and Wildlife Service but they did not submit comments. <br /> <br />Commissioner Rye moved, seconded by Commissioner Sand to recommend approval of <br />Planning Case #00-15, rear yard variance (23 feet 6 inches where 30 feet is required) for <br />an addition of deck based on the "Findings - Rear Yard Setback Variance" section of the <br />staff report dated March 1, 2000, and with the following condition: <br /> <br />I. Ifthe structure is damaged in excess of the building code threshold for damage, <br />the variance would no longer be valid. <br /> <br />e <br /> <br />The motion carried unanimously (4-0). <br /> <br />This Planning Case will be reviewed at the Monday, March 13, 2000, City Council meeting. <br /> <br />Mr. Aleksander advised of the option to move the footings back toward the house if that helps <br />with the request. Ms. Randall stated a variance would still be needed. <br /> <br />Chair Erickson recessed the meeting at 9:20 p.m. The meeting was reconvened at 9:25 p.m. <br /> <br />PLANNING CASE #00-11 - CITY OF ARDEN HILLS - VARIANCE PROCEDURE - <br />DISCUSSION ONLY <br /> <br />Ms. Randall explained that staff is requesting that the Planning Commission commence the <br />review and discussion of the existing variance procedure and determine if any changes should be <br />made to the ordinance. At the last meeting, the Planning Commission discussed the City of <br />Roseville's administrative permit process for variances along with the language used by the City <br />of Hopkins. Staff was asked to bring further information on past variances, and incorporate a <br />location and language similar to Hopkins in the current Zoning Ordinance. <br /> <br />Ms. Randall presented the table of variances from 1995 to date along with a map of each site. <br />She pointed out the sites that would not have needed a variance with the proposed language, <br />noting a few variances that were denied would be approved under the suggested language <br />change. <br /> <br />e <br />
