... ,

"

I'
..

.

.

.

MEMORANDUM

March 8, 2000

TO:
FROM:

City Council V I~
City Administrator <1~'~

CC:

Lake Josephine East file

RE:

Lake Josephine East road

Back~round

Enclosed within are copies of the minutes from the June 28 and August 9, 1999 City
Council meetings at which the Council discussed and clarified it's position with regard to
the Lake Josephine East development. I have also enclosed copies of the Temporary
Road Easement and construction plans of the cul-de-sac, a memorandum from the
Planner to the Planning commission outlining the conditions for approval, and recent
correspondence with the parties involved in this conflict.

My basic understanding is that Mr. Evertz and Mr. Rekuski were given a 24 month time
period in which to negotiate with Ms. Dee Rushenberg( 3168 Shoreline Lane) and Mr. &
Mrs. Wesslund(3l67 Shoreline Lane) foraccquisition of their property, to the city of
Arden Hills, for the extension of Shoreline Lane. The road would then extend across the
Evertz/Rekuski development and end at their northern boundary. A cul-de-sac was
allowed on the Evertz/Rekuski property until such time that the road would be punched
through to the north. The City has money in escrow to convert the cul-de-sac to the
through street. The official map of the City of Arden Hills shows that this road would
eventually be extended to the north across the Bachman property and linked to an
existing road section of Shoreline Lane.

The further development of the Evertz/Rekuski property was conditioned on reaching
agreement with Rushenberg and Wesslund parties so that public access could be
constructed and the two western parcels of the proposed development had adequate and
proper access.

Current

18 months have passed since the developers were required to obtain the easement and
record it. Mr. Evertz and Mr. Rekuski approached the city wanting to go to the Council
and have you condemn the property for the r-o-w. They claimed that the neighbors had
not responded to their offer and felt that
