They were
hesitant to pay more than they had originally offered( $2,000) and indicated they would

have to get back to the city. They later responded with agreement in writing. We
indicated to both parties that we would bring this issue to you at this time if we felt that
we couldn't help to resolve this.

Action

The parties will appear before you on March 13, 2000 wanting to know what to do about
this situation. We offer the following as options for you consideration:

. Do nothing-let them continue to try to work things out for the remaining 6 months
. Consider condemning the area across Wesslund and Rushenberg property for road
purposes
. Consider condemning not only the area for r-o-w across Rushenberg and Wesslund
property, but also across the Bachman property to complete the connection of
Shoreline Lane as shown on the official map
. Consider an independent appraisal of the value of the property needed for the road,
the cost of which should be borne by the developers-the agreement would still be in
place requiring the developers to pay the value determined by the appraisal
. Require both parties to obtain independent appraisals which will then be reviewed
and a value determined by a third appraiser appointed by the city- make this binding
arbitration
