The applicant is requesting approval of a corner side yard setback variance (7 <br />feet proposed, when 40 feet is required) for a porch addition on a single-family lot zoned <br />R-2 (Exhibit A). <br /> <br />. <br /> <br />The proposed porch addition is 183 square feet running along the front and side of the <br />home. The applicant currently has an 8 by 30-foot (240 square foot) porch on the rear on <br />the home. The applicant desires to build a porch on the street side to enhance the <br />property. It appears that there was a porch in front of the existing door at one time due to <br />some existing footings. The property is currently a rental property. <br /> <br />Findinl!:s - Corner Side Yard Setback Variance <br />Staff concludes that the following factors relate to the requested variance: <br /> <br />1. Circumstances Unique to the Property: The house currently is 15.37 feet (where 40 <br />feet is required) from the easement line. The house was built (moved) prior to the <br />current setback restrictions. It appears at one time (due to some existing footings) <br />there was a porch approximately 5 by 8 feet in front of the door. Any front entryway <br />will require a variance. <br /> <br />2. Variance not greater than necessary: The variance can be reduced by eliminating the <br />8 by 14- foot section on the northeast side. <br /> <br />Deadline for Agency Actions. The City of Arden Hills received the completed <br />application for this request on January 31, 2000. Pursuant to Minnesota State Statute, the <br />City must act on this request by Friday, March 31, 2000 (60 days), unless the City <br />provides the petitioner with written reasons for an additional 60-day review period. The <br />additional review period would extend to Monday, May 29, 2000. The City may with the <br />petitioners consent, extend the review period beyond the Monday, May 29, 2000, date. <br /> <br />e <br /> <br />Lastly, if the City denies the petitioners request, "...it must state in writing the reasons for <br />the denial at the time that it denies the request." <br /> <br />Note: Zoning Ordinance Section VIII, E, 4, states no application which has been denied <br />wholly or in part shall be resubmitted for a period of six (6) months from the date of said <br />order of denial. <br />
