<br />e <br /> <br />CITY OF ARDEN HILLS <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />April 12, 2000 <br /> <br />TO: <br /> <br />Joe Lynch, City Administrator <br />Terrance Post, City Accountant (ff;i) <br /> <br />City of Arden Hills Code Discussion Regardiug Charitable <br />Gambling Trade Area Restriction <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />Backl!round <br />At the April I 0, 2000 regular Council meeting, a premises permit application for St. <br />Katherine Ukrainian Orthodox Church (Resolution #00-17) was tabled until the April 24, <br />2000 regular Council meeting. Staff was directed to include an agenda policy discussion <br />item for the April 17 , 2000 Council work session regarding the charitable gambling trade <br />area restriction portion of the City Code. <br /> <br />e <br /> <br />Situation <br />The charitable gambling premises permit application by St. Katherine Orthodox Church <br />represents a unique situation in that it represents the first premises permit application <br />received from an organization with a "bricks and mortar" presence within the trade area. <br />As a 501 (c) (3) organization, the church, under the current ordinance language, has the <br />opportunity to expend up to ninety (90) percent of the net charitable gambling profits to <br />itself to support church activities. <br /> <br />Issue <br />Is it the intent of the Arden Hills City Council to allow licensed charitable gambling <br />organizations to satisfY the ordinance trade area spending requirement by expending <br />more than fifty (50) percent of net profits for internal organizational purposes (assuming <br />it is located in the trade area); or must at least fifty (50) percent of the net profits be spent <br />for lawful purposes with other organizations within the trade area? <br /> <br />Discussion <br />This is a policy matter for Council discussion and consideration. Council may conclude <br />that existing ordinance language is appropriate or direct staff to create an ordinance <br />revising section 4-43 "Trade area restriction", of the existing City Code. <br /> <br />. <br />
