The City is authorized to adopt trade area regulations <br />and all of the City's regulations can be more restrictive than the regulations of the State of <br />Minnesota (M.S. 349.213). <br /> <br />The debt reduction prohibition in the Ordinance is modeled on language contained in M.S. <br />349.12, Subd. b wnich indicates that certain kinds of expenditures are not expenditures for <br />lawful purposes. A,; it relates to building construction or debt retirement, the relevant part <br />of the statute reads as follows: <br /> <br />"Lawl'ul purpose" does not include expenditures made for "the <br />erection, acquisition, improvement, expansion, or maintenance <br />of rea I property or capital assets owned or leased by an <br />organization, unless the board has first specifically authorized <br />the e;<penditures after finding that: <br /> <br />1.
