<br />, <br /> <br />in a form and substance reasonably acceptable to the City Attorney. <br /> <br />e <br /> <br />B. Extension of Shoreline Lane. The plat shall dedicate an extension of Shoreline <br />Lane through the Property as shown on the final plat approved May 24, 1999. <br />(See Subsection 1 E, below.) <br /> <br />C. Gradine: Plan. Sediment and Erosion Control Measures. The plans and <br />specifications for the grading plan and the erosion control measures (the <br />"Grading/Erosion Control Plans and Specifications") are attached hereto as <br />Exhibit A. All streets and utilities for the project must be constructed in <br />accordance with the Grading/Erosion Control Plans and Specifications. In <br />addition: <br /> <br />1.. All landscaping, sodding, seeding, or planting performed by the <br />Developer pursuant to this Development Agreement or any other contract <br />(collectively, the "Landscaping") shall continue to be the responsibility <br />of the Developer until the earlier of the following: <br /> <br />A. One year from the date of any such landscaping; or, <br /> <br />B. <br /> <br />The closing on the sale of any lot on which the Landscaping was <br />performed. <br /> <br />e <br /> <br />2. Developer shall seed or sod all disturbed areas outside of the street right- <br />of-way within ten (10) days of completion of grading; <br /> <br />3. All work necessary to complete the grading plan and erosion control <br />measures pursuant to the Grading/Erosion Control Plans and <br />Specifications shall be completed no later than June 30, 2000. <br /> <br />Any handwritten notations or modifications may have been added to Exhibit A <br />and required by the Development Agreement shall be incorporated by the <br />Developer into a final draft of Exhibit A and certified by a registered surveyor. <br /> <br />D. Park Dedication Fee. The Developer shall pay the City a park dedication fee in <br />the amount of $14,184.00. The payment of the park dedication fee shall be <br />allocated equally between each of the four lots contemplated by the plat, and <br />shall be paid no later than the earlier of the following: <br /> <br />A. Issuance of a building permit with respect to said lot; or <br />B. The closing on the sale of the lot to an entity jperson other than <br />the developer. <br /> <br />e <br /> <br />2 <br />
