<br />In addition to whatever other remedies the City may have, Developer's <br />failure to comply with the terms of this section shall permit the City <br />Engineer to issue a stop work order which may result in rejection of the <br />work and which shall obligate the Developer to take all reasonable steps, <br />as directed by the City's Engineer, to insure that the improvements are <br />constructed and inspected pursuant to the terms of this Agreement. <br />Such failure to comply shall further result in the assessment of a penalty <br />in an amount equal to 1 %, per occurrence, of the amount of security <br />. required in Section 1. O. attributable to underground pipe and street <br />construction. <br /> <br />3. The City reserves the right to test as necessary, at the Developer's <br />expense, all grading work. At a minimum, a test roll of the street <br />subgrade shall be passed prior to acceptance of the subgrade by the City. <br /> <br />4. Subgrading and the initial course of the street improvements shall be <br />completed by August 15, 2000. The final wear course of the street <br />improvement shall be completed by November 1, 2000.. <br /> <br />5. All utilities shall be installed by the appropriate utility company; <br /> <br />6. <br /> <br />The Developer shall arrange for the installation of underground gas, <br />electric, telephone and cable TV after the first lift of asphalt is complete, <br />but before the final lift is started; <br /> <br />7. All utilities improvements shall be completed by July 15, 2000. <br /> <br />Any handwritten notations or modifications may have been added to Exhibit 8 <br />and required by the Development Agreement shall be incorporated by the <br />Developer into a final draft of Exhibit 8 and certified by a registered engineer. <br /> <br />J. Temporary Cul-de-Sac Easement. Prior to the endorsement of approval on the <br />final plat, the Developer shall provide the City with a temporary easement in the <br />form of the attached Exhibit C. <br /> <br />K. ACQuisition of Rie:ht-of-Wav From the South. The Developer and City shall <br />enter into an easement agreement relative to the acquisition of certain real <br />property to the south of the plat prior to the endorsement of approval on the <br />final plat. The form of the easement agreement shall be in the form of the <br />attached Exhibit D. <br /> <br />L. <br /> <br />Attornev's Fees. The City hereby acknowledges the receipt of $1,118.10 as <br />and for the attorney's fees required to be paid in accordance with the Approval. <br /> <br />4 <br /> <br />e <br /> <br />e <br /> <br />e <br />
