The motion carried unanimously (5-0).

PLANNING CASE #00-14 - CHUCK MERTENSOTTO- 3491 LAKE JOHANNA
BOULEVARD - CORNER SIDE YARD VARIANCE - PUBLIC HEARING

City Planner Chaput explained that the applicant requests approval of a variance from the comer
side yard setback requirements (12 feet proposed, when 40 feet is required) for a porch addition
on a single-family lot, zoned R-2.

City Planner Chaput reviewed that the applicant came before the Planning Commission in March
of this year. At that time, his plan showed a porch on the north and east sides of the existing
structure. The Planning Commission made a recommendation that the variance be approved with
the condition that the 8' x 14' proposed construction on the north side of the house be eliminated.
This application and recommendation went to the next regular Council meeting at which time it
was tabled. At that time, the drawings were being modified by the applicant. The sixty-day time
period was extended on this application and then waived by the applicant at the May 8, 2000,
City Council meeting and new plans were also provided at this meeting. Since the variance
request had changed with the submission of new plans, the applicant was asked to return to the
Planning Commission for review of the application.

The applicant took into consideration the Planning Commission's recommendation to eliminate
the 8' x 14' section of the porch on the side of the house. However, it was not completely
eliminated and an area of 11' -6" x 2' -8" still remained on the north side of the house on the new
proposal.
