<br />Signage. The Zoning Ordinance in Section V, K, 5, g, (1), requires that a sign plan be
<br />submitted in conjunction with site plans in the GB district that show the location, type,
<br />size and design of the individual signs. The applicant is proposing one Area
<br />Identification Sign with each of the three phases. However, the size and design of the
<br />sign have not been included in the submittal. Also, the applicant is providing for two
<br />business signs which are 60 square feet in area at each of the four entries to the building
<br />for a total of 480 square feet of signage on the building (60 sfx 2 signs x 4 entries) which
<br />is less than 10 percent of the buildings facade as required by the Sign Ordinance,
<br />Schedule VII, B, 1.

<br />21. Rooftop Mechanical. The Zoning Ordinance in Section VI, E, 4, j, requires that all
<br />rooftop mechanical equipment shall be screened so as to prevent direct viewing of said
<br />equipment. The rooftop mechanical equipment will consist oflow profile units painted to
<br />match the buildings exterior and are located such that they will be screened to prevent
<br />direct viewing.

<br />22. Lighting. The Zoning Ordinance in Section V, E, 3, a, b, and c, states that the lighting
<br />shall be directed away from adjacent properties, the source of illumination shall be
<br />concealed, and the intensity oflighting from developments shall not exceed one
<br />footcandle onto public right's-of-way. The applicant is proposing to use quick cut-off,
<br />shoe-box type lumenajres which would meet the Code requirements.

<br />Environmental Assessment Worksheet (EA W). Given, the size of the project (phases
<br />I, II, III, and IV are in excess of 300,000 square feet) an EA W was required to prepared
<br />pursuant to Minnesota Rules, Chapter 4410. An EA W has a 30 day comment period.
<br />The comment period for this EA Wends on July 2, 1997. Therefore, the Planning
<br />Commission will have all the public comments, and hopefully all of the applicants
<br />responses, available for your deliberations. The Staffhas included in your packet a copy
<br />of the EA Wand all public comments which have received to date, including applicant
<br />responses, if any.

<br />24. Indirect Source Permit (ISP). The project (Phases I, II, III, and IV) does not contain an
<br />adequate number of parking spaces (ie., greater than 1,000) to fall under the jurisdiction
<br />and therefore require and ISP (Exhibit H).

<br />Variances
<br />A. General Ordinance Requirement.
<br />The conditions required for the approval of a variance are found in Section VIII, D, 4, c,
<br />of the City Code which states the following: "Adherence to the provisions of this
<br />ordinance is required except for special cases which arise because of the configuration of
<br />a particular parcel. The condition shall not have been created by the landowner. A
<br />variance or variances may be granted from specific provisions of this ordinance because
<br />such land factors as length of a side of a lot, the shape of the lot or the unusual terrain
<br />prohibit reasonable development equivalent to that which would be permitted without
<br />variance on a similar size lot located in the same district, but which lot has no unusual
<br />configuration. Economic conditions alone shall not be grounds for a variance."
