<br />e <br /> <br />e <br /> <br />e <br /> <br />ENVIRONMENTAL PROTECTION PROVISIONS <br /> <br />This conveyance is expressly made subject to the following environmental notices, <br />exceptions, restrictions, agreements and covenants affecting the granted premises hereby <br />conveyed to the extent and only to the extent the same are valid and affect the granted premises, <br />and shall be considered as covenants running with !he land and binding on all parties having any <br />right, title or interest in the granted premises or any part thereof, their heirs, successors and <br />assigns. <br /> <br />A. Inclusion of Environmental Protection Provisions <br /> <br />The Grantee, its successors or assigns shall neither transfer the granted premises, lease the <br />granted premises, nor grant any interest, privilege, or license whatsoever in connection with the <br />granted premises, without the inclusion of the environmental protection provisions contained <br />herein, and shall require the inclusion of same in all future deeds, transfers, leases, or grant of <br />any interest, privilege, or license. <br /> <br />B. No Liability For Non-Army Contamination <br /> <br />The Grantor shall not incur liability for additional response action or corrective action found to <br />be necessary after the date of transfer in any case in which the person or entity to whom the <br />granted premises are transferred, or other non-Army entities, is identified as the party responsible <br />for contamination of the granted premises. <br /> <br />C. Unrestricted Use/Proposed New City Hall <br /> <br />The Department of the Army has undertaken careful environmental study of the granted <br />premises and concluded, to which !he Grantee agrees, that the highest and best use ofthe granted <br />premises at this time is to construct a new city hall. In order to protect human health and the <br />environment and further the common environmental objectives and land use plans of the United <br />States, the State of Minnesota, and the Grantee, the following notifications are included in this <br />deed to assure the use of the granted premises is consistent with the environmental condition of <br />the granted premises. These notifications benefit the lands retained by the Grantor and the public <br />welfare generally and are consistent with state and federal environmental statutes: <br /> <br />1) Special Well Construction Area <br /> <br />The Minnesota Department of health has designated a Special Well Construction Area <br />that includes these granted premises. The Special Well Construction Area designation <br />became effective on July I, 1996 and will remain in effect until further notice. <br /> <br />4 <br />
