Y <br />Resolution to appoint data practices compliance officer <br /> <br />Ann Higgins <br /> <br />Minnesota Statutes Section 13.05, subd. 13 requires cities <br />to appoint a city employee to act as its data practices <br />compliance official. That employee shall receive questions <br />or concerns regarding problems in obtaining access to <br />public data or other data practices issues. <br />Recently the Dept. of Administntion prepared a <br />sample resolution for appointing a data practices compli- <br /> <br />ance official. This is part of the department's requirement <br />to provide model policies and training assistance to cities <br />when complying with the Government Data Practices Act <br />(GDPA). <br />Below is a sample resolution. For more information <br />on data practices compliance and requirements under state <br />law, contact Ann Higgins at the League, (65t) 281-1257'1: <br /> <br />Sample resolution appointing data practices compliance official <br /> <br />State of Minnesota <br /> <br />City of <br /> <br />Title: Appointment of Data Practices Compliance Official <br /> <br />WHEREAS, Minnesota Statutes, Section 13.05 Subd. 13 requires that the city appoint a city employee to <br />act as its data practices compliance official to receive questions or concerns regarding problems in obtaining <br />access to data or other data practices problems within the city, and, <br /> <br />WHEREAS, the city council shares the Concern expressed by the Legislature about access to city data and <br />wishes to satisfY this concern by inunediately appointing a qualified data practices compliance official as <br />required under statute. <br /> <br />BE IT RESOLVED, the city council appoints as the data practices <br />compliance official to receive questions and concerns regarding problems in obtaining access to data or <br />other data practices problems. <br /> <br />ADOPTED BY <br /> <br />CITY COUNCIL ON <br /> <br />(D"l~l <br /> <br />ATTESTED TO BYTHE: <br /> <br />on <br /> <br />(Sign"rur~ofM"yor) <br /> <br />(Due) <br /> <br />on <br /> <br />{SiWU,u,...,ofClcrt} <br /> <br />(D~[~) <br /> <br />Note:The statute also aUows the responsible authority to appoint or designate the data practices compliance <br />official.
