I am the president of Lindey' s Inc., and the <br />managing partner of the Lindemer Family Limited Partnership, a partnership formed <br />by my family, whose purpose is to perpetuate the business activities established by our <br />parents in 1958. <br /> <br />I appear before you to express our objection to the proposed rezoning of <br />Lindey's property from it's current B-2 General Business District designation to the <br />recently created NB Neighborhood Business District. <br /> <br />Lindey's Prime Steak House has occupied it's place in Arden Hills since 1961. <br />Lindey's began operation on the property 39 years ago. Lindey's has not been the only <br />business to operate at our corner of Old Snelling Ave. and County Road E. Prior to <br />1961 this site was owned and occupied by another dining establishment called the <br />Wagon Wheel. The Wagon Wheel began operation on this property around 1930, <br />seventy odd years ago. <br /> <br />It is, in our opinion, important that the Commission take note of certain <br />suppositions previously published. The Public Hearing Notice inviting comment on the <br />creation of the NB zone contains a section entitled PURPOSE OF DISTRICT. Within <br />this preamble to the later adopted ordinance creating the NB Neighborhood Business <br />District designation are suppositions which we would like to address point by point: <br /> <br />Purpose a: <br /> <br />To be located at the edge of residential neighborhoods. <br /> <br />Supposes: <br /> <br />That a new business is to be located and should be placed at the edge of <br />existing residential area. <br /> <br />Response: <br /> <br />When an existing business, and another of like character <br />before it, predate surrounding residential areas by as much as 65 <br />years, it is clear neighboring residents have chosen to live in <br />proximity to the business in it's current zoning and in it's current use. <br /> <br />Purpose b: <br /> <br />To provide a limited range of over-the-counter, convenience, retail, <br />and service uses to accommodate the needs of the adjacent residents. <br /> <br />Supposes: <br /> <br />The times and uses of the property must be limited, and must focus on <br />adjacent residents. <br />
