<br />. <br /> <br />2.0 <br /> <br />. <br /> <br />. <br /> <br />Arden South A~artments <br />Final PUD Permit and Development Agreement <br /> <br />1.0 <br /> <br />Parties. This Agreement is dated the _ day of ,2001, and is <br />entered into by and between the City of Arden Hills, a Minnesota municipal <br />corporation (herein "City"); and Beacon Construction, a Mirmesota Corporation <br />("Beacon"). <br /> <br />Recitals. <br /> <br />A. Beacon represents that it is owner of or has a right to purchase the <br />following described property located in Ramsey County, Minnesota, to <br />wit: <br /> <br />Parcel No. I: <br /> <br />Tract A, Registered Land Survey No. 496 Ramsey County, Minnesota <br /> <br />Parcel No.2: <br /> <br />All that part of the following described tract: That part of Lot 5 except the <br />Northerly 21.3 feet and Lot 6 except the South 50 Y2feet, Rohleder's Home <br />and Garden Acres, lying Easterly of the Highway as presently located and <br />established, which lies Southeasterly of a line run parallel with and distant <br />60 feet Southeasterly of the following described line: Beginning at a point <br />on the East and West quarter line of Section 28, Township 30 North, <br />Range 23 West, distant 539.13 feet East of the West quarter corner <br />thereof <br /> <br />B. <br /> <br />Beacon is proposing to develop a 30-unit apartment building on combined <br />Parcels I and 2 ("Improvement Project") pursuant to the plans and <br />specifications prepared by Plow Engineering, Inc., and WSI Architects <br />("Plans and Specifications"). <br /> <br />c. <br /> <br />In order to facilitate its Improvement Project, Beacon has made <br />applications to amend the City's comprehensive plan; to rezone Parcels 1 <br />and 2; to approve a Planned Unit Development Master Plan; and to <br />approve a Planned Unit Development Pinal Plan ("Beacon <br />Applications"). <br /> <br />D. <br /> <br />In order to comply with the City's development regulations, Beacon will <br />also need to combine Parcels 1 and 2 and to obtain Final Plat approval <br />from the City for the combined Parcels. <br /> <br />I <br />
