<br />e- <br /> <br />"PUD Final Plan". Any change in the PUD Final Plan shall require City <br />CUl1ll~il dfJprovat-- <br /> <br />B. Gradinl! and Draina!!e. Grading and drainage improvements shall be <br />constructed pursuant to the PUD Final Plan and shall be completed on or <br />before the 30th day of August, 2001. <br /> <br />C. Landscapinl!. Landscaping improvements shall be installed pursuant to <br />the PUD Final Plan and shall be completed on or before the 30th day of <br />August, 2001. ("Completion Date"). The estimated cost of the <br />landscaping improvements is $_. Beacon shall provide the City with <br />a landscaping performance bond or other form of security acceptable to <br />the City Attorney in an amount equal to 125% of the estimated cost of the <br />landscaping improvements. The performance bond or other form of <br />security shall be valid for one year from the completion date. <br /> <br />D. Conditions Precedent. Prior to the issuance of a grading, excavation, or <br />building permit, Beacon shall: <br /> <br />I. Obtain and file with the City Administrator a permit from Ramsey <br />County for work to be done within the County right-of-way. <br /> <br />e <br /> <br />2. <br /> <br />Obtain and file with the City Administrator a permit from the Rice <br />Creek Watershed District for drainage and ponding improvements. <br /> <br />3. Provide the City Administrator with a utility easement for the area <br />of the lift station currently located on Parcel No.1. The exact <br />location and dimension of the easements shall be approved by the <br />City Engineer and the form of easement shall be approved by the <br />City Attorney, <br /> <br />4. Provide evidence of title or the right to acquire title to Parcels I <br />and 2. <br /> <br />E. Certificate of Occupancy. Beacon explicitly understands that all City <br />approvals are based on upon the acquisition and platting of combined <br />Parcels I and 2. Beacon acknowledges and agrees to itself and its <br />successors and assigns that the City may withhold a Certificate of <br />Occupancy for the building to be constructed as part of the Improvement <br />Project if Beacon fails to obtain Final Plat approval for combined Parcels <br />I and 2 prior to its request for a Certificate of Occupancy. Nothing herein <br />shall obligate the City to approve the Final Plat for combined Parcels I <br />and 2 unless the proposed Plat otherwise complies with the City's platting <br />regulations. <br /> <br />- <br /> <br />3 <br />
