<br />e <br /> <br />e <br /> <br />e <br /> <br />Sec. 8.5-5. Permit Required. Except as exempted by Section 8.5-2(F), any person, firm, sole <br />proprietorship, partnership, corporation, state agency or political subdivision thereof proposing <br />Land Disturbance Activity within the city of Arden Hills shall apply to the City Administrator <br />for an Erosion Control and Sediment Plan Permit. No land shall be disturbed until the permit is <br />approved by the City Council and conforms to the standards set forth herein. A permit <br />application shall include the following: <br /> <br />A. Aoolication Fee. The developer shall submit an application fee as specified on the <br />City's Fee Schedule as adopted and revised annually by the City Council, from <br />time to time, by city council resolution. The fee is non-refundable and shall cover <br />any review costs accrued with in one (I) year of the date of payment. <br /> <br />B. Plan. The proposed Erosion and Sediment Control Plan prepared in compliance <br />with the Ramsey County Erosion and Sediment Control Handbook or any <br />variances to such handbook approved by the District Board. <br /> <br />C. Miscellaneous. Other information as required by the City Administrator. <br /> <br />Sec. 8.5-6. Review of Permit Aoolication. Within thirty (30) days of receipt ofa completed <br />application, the City Administrator shall make recommendations to the City Council for <br />Approval or Denial of the Permit. The City Council shall take final action within thirty (30) <br />days of receipt of the recommendations of the City Administrator. The City may attach <br />conditions to the permit which address the following items: <br /> <br />A. Easement. Dedication of an easement to the city for any permanent erosion and <br />sediment control practice(s) that remain after the Land Disturbance Activity is <br />completed. <br /> <br />B. Maintenance. Responsibility for the Maintenance ofthe permanent erosion and <br />sediment control practices for the period of the Land Disturbance Activity, in, if <br />necessary, thereafter. The City shall assign the maintenance responsibility for a <br />permanent erosion and sediment control practice after that time. <br /> <br />C. Escrow Requirement. The escrow of a sum of money sufficient to insure the <br />installation, completion and maintenance of the Erosion and Sediment Control <br />Plan and Practices. <br /> <br />Sec. 8.5-7. Modification of Plan. An approved Erosion and Sediment Control Plan which has <br />been approved as part of the permitting process may be modified upon submission of an <br />application for modification to the City Administrator. A request for an Erosion Control and <br />Sediment Plan permit modification shall be processed in the same manner as the original permit <br />and the City may require additional reports and data. <br />
