If either party has not been able to <br />complete its obligations underthis Interim Agreement within the initial <br />twelve-month term, but has made reasonable progress; and if the <br />delays are the result of matters beyond the party's control, the party <br />may extend the term of this Agreement for an additional twelve <br />months by written notice to the other party. Thereafter, the term of this <br />Agreement may be extended by mutual consent of the parties for six <br />additional months. <br /> <br />4. Default. If Developer fails to perform its obligations under Section <br />3.0E, the City may serve Notice of Default upon the Developer, by <br />certified mail, return receipt requested, The Developer shall have <br />thirty (30) days from the date of the Notice of Default to cure the <br />default or the City may terminate this Interim Agreement. <br /> <br />H. Data and Reports, Developer shall provide City with copies of the reports <br />and studies as identified on Exhibit D.
