<br />Section 339.03 - GENERAL REGULATIONS <br /> <br />. <br /> <br />Snbd. 1. Sale of Fertilizer Containing Phosphorous. Effective 31 July 2002, no person, firm, <br />corporation, franchise, or commercial establishment shall sell any lawn fertilizer, liquid or <br />granular, within the city of Arden Hills that contains any amount of phosphorous or other <br />compound containing phosphorous, such as phosphate, except: <br /> <br />A. Effective 31 July 2002. Small quantities of such fertilizer may be sold for <br />use for the following as allowcd by Minnesota State Statute: <br /> <br />1. a tissue, soil, or other test be a laboratory or method approved by <br />the Minnesota Commissioner of Agriculture and performed within <br />the last three years indicates that the levels of available <br />phosphorous in the soil is insufficient to support health turf <br />growth; <br />11. the property owner or agent is first establishing turf via seed or sod <br />procedures, and only during the first growing season; or <br />111. the fertilizer containing the plant food phosphorous is used on a <br />golf course under the direction of a person licensed, certified, or <br />approved by an organization with an ongoing training program <br />approvcd by the Minnesota Commissioner of Agriculture. <br /> <br />Displays of lawn fertilizer containing phosphorous shall be limited to ten <br />percent (10%) of the quantity of non-phosphorous lawn fertilizer on display at <br />any given time. Use of lawn fertilizer containing phosphorous allowed under <br />this section shall not exceed rates recommended by the University of <br />Minnesota and approved by the Minnesota Commissioner of Agriculture. <br /> <br />. <br /> <br />B. Effective 31 July 2002. Displays of such fertilizer must be clearly marked as <br />containing phosphorous, and must be separated from the display of other <br />fertilizers by no less than eight (8) feet. <br /> <br />C. Effective 31 July 2002. For cach sale of such fertilizer the seller shall <br />provide the buyer with a copy ofthis Chapter ofthe Arden Hills City Code. <br /> <br />Section 339.04 - PENALTY <br /> <br />Subd. 1. Any person violating this Chapter shall be guilty of a petty misdemeanor. <br /> <br />Effective Date: <br /> <br />This ordinance shall become cffective the day following its <br />publication. <br /> <br />Adoption Date: <br /> <br />Passed by the City Council of the City of Arden Hills <br />the 8th day of July 2002. <br /> <br />. <br /> <br />Ordinance #339 <br />Page 2 <br />
