Review and comment on data collected and <br />analyzcd by Developer. <br /> <br />f. Share Information. Provide Developer with data obtained <br />during City's activities pursuant to this Section 3.C.2. <br /> <br />D. DisDosition and Develooment Agreement. <br /> <br />I. <br /> <br />Exclusive Right to Negotiate. During the term of this Intcrim <br />Agreement, Developer shall have the exclusive right to ncgotiate with <br />the City regarding thc acquisition and development of the TCAAP Site <br />or any portion thereof. City shall not solicit or entertain bids or <br />proposals from third parties in regard to disposition and dcvclopmcnt <br />of any portion of the TCAAP Site without prior written consent of the <br />Developer. <br /> <br />. <br /> <br />2. Developer Participation. The parties anticipate that during the term <br />of this Interim Agreement, communications and negotiations with the <br />Army, GSA, and other third parties may take place concerning the <br />acquisition of the sTGAAPSite and necessary approvals for any <br />proposed projects. Dcvcloper shall be entitlcd to participate in such <br />discussions unless any said third party objects to the participation by <br />the Developer; or it is legally inappropriate for the Developer to <br />participate in the discussions or negotiations taking place in a closed- <br />session of a public agency. Each party hereto shall keep the other <br />party informed as to the nature and progress of any such discussions. <br /> <br />3. Re~ular Meetinli:s. Thc parties shall conduct regularly scheduled <br />meetings until the initial draft of the DDA is prepared and subsequcnt <br />meetings as necessary to incorporate data obtained during the <br /> <br />. <br /> <br />6 <br />
