Steel, lnc, (A.T.S.) and HPMK, LLC have asked that I communicate with <br />you in writing expressing their e)(treme frustration with your company's refusal to negotiate <br />for the purchase of the A.T. S. parcel. By way ofhistoncal summary, you presented a written <br />Memorandum of Understanding for the purchase of the 4.2 acre A.T.S, parcel and 53,872 sq, <br />ft. building in October of 2000. The proposed purchase price was $1,320,000_ This amount is <br />wbstantially less than the present estimated market value for tax purposes, and, as you have <br />acknowledged to I!le. was not based upon any appraisal of the property. <br /> <br />You, as well as other representatives of your development company, have repeatedly <br />represented to the City of Arden Hills your "intentioll" to acquire the A.T.S, parcel in <br />furtherance of your development plans for the Gateway Business Disttict. In reliance upon <br />your representations and application, the Cjty of Arden Hills approved on March 26,2001. the <br />proposed Master POO. Pursuant to this approval, Chesapeake was granted an IS-month <br />window in which to assemble all rCTl111ining parcels and secure a major corporate tenant/user. <br />Condition 14 of the City approval of the Master PUD clearly States that "approval of the <br />Master plan is contingent on the applicants acquisition of all properties shown in the <br />proposal."
