The installation of a traffic signal at the intersection of "Cummings Park Drive" and <br />Lexington Avenue at Guidant's expense. <br />3. Reconstructing "Cummings Park Drive" at Guidant's expense in accordance with plans <br />and specifications approved by the City Engineer. <br />4. Execution of a development agreement for developer installed public improvements. <br />5. Provision ofan access easement to Xce1 Energy. <br />6. Compliance with applicable provisions of the City Code and related ordinances. <br />7. If the City denies the petitioners request, <br />".,.it must state in writing the reasons for the denial at the time it denies the request." <br />4, Table for additional information. <br /> <br />Deadline for Agencv Actions: Preliminary Plat <br /> <br />With regard to subdivision applications, Minnesota State Statute 462.358 Subd. 3B indicates the <br />following: <br /> <br />A subdivision application shall be preliminarily approved or disapproved within 120 <br />days following delivery of an application completed in compliance with the municipal <br />ordinance by the applicant to the municipality, unless an extension of the review period <br />has been agreed to by the applicant, <br /> <br />This particular application was received September 9,2002. As a result, the application must <br />receive a preliminary approval or denial by January 7, 2002. <br /> <br />Planning Commission Recommendation: Planned Unit Development Master Plan <br /> <br />In Planning Case #02-25B the Planning Commission recommends approval ofthe Planned Unit <br />Development Master Plan with the following conditions: <br /> <br />1. Approval of a PUD Permit and Development Agreement. <br />2. The phasing schedule follow the revised schedule proposed by staff. <br />3. An updated traffic study be completed at the conclusion of Phase I Development and at <br />the conclusion of Phase II Development. <br />4. Approval of the Final Alternative Urban Areawide Review Mitigation Plan. <br />5. Submittal of a revised Drainage and Utility Plan as approved by the City Engineer. <br /> <br />Options <br />
