Day care facilities of ten <br />or more students are not allowed in the R-1 District. However, schools, <br />nurseries, houses of worship, institutional housing, and public uses are all <br />permitted as special uses within the R-1 Zoning District. Given the fact that the <br />proposed daycare facility will be integrated with an existing, approved use, staff <br />directed the applicant to apply for an amendment to their existing special use <br />permit. <br /> <br />The applicant is currently requesting an amendment to allow daycare for up to 15 a <br />children. A revised special use permit document has been attached for your .. <br />review. The following conditions of approval have been incorporated into the <br />revised special use permit: <br /> <br />. Daycare enrollment be limited to 15 children. <br /> <br />. Daycare hours of operation be restricted 6:00 am to 6:00 pm. <br /> <br />. Compliance with the Fire and Building Code. <br /> <br />. Compliance with applicable County and State licensing regulations for <br />daycare facilities. <br /> <br />. Compliance with previously approved special use permits. <br /> <br />Aside from the conditions identified above, the Planning Commission may also <br />want to consider the issue of fencing the playground portion of the property given <br />its proximity to Highway 96. However, there is no specific language in the Zoning <br />Ordinance requiring this. Additionally, it is presumed that safety issues <br />associated with the property are addressed in conjunction with applicant's <br />licensing through the County.
