Ramsey County is the only charter county in the State of Minnesota. The <br />Ramsey County Charter includes the following provisions: <br /> <br />1. To acquire by gift, devise, purchase or condemnation any property on such <br />terms as the Cou nty Board deems appropriate, and to sell or lease any property <br />of the County, if needed, for the full discharge of the powers and duties of the <br />County, subject to this Charter and State law, (Ramsey Charter Section 2.02, <br />Subd. l). <br /> <br />2. To contract for acquisition, construction, or improvement of real property or <br />buildi ngs in a manner determined by the County Board, to serve the interests of <br />the public in regard to cost, speed, and quality of construction. Alternative <br />construction procurement methods inciude, but are not limited to: (1) the <br />solicitation of proposals for construction on a design/build basis and subsequent <br />negotiation of contract terms; or (2) the solicitation of proposals for a <br />construction management agreement which may include a guaranteed <br />maximum price, (Ramsey County Charter Section 2.02, Subd. M), <br /> <br />It is the County Attorney's position that the flexible design/build provisions of its Charter <br />supersede the competitive bidding requirements of the Uniform Contracting Law (M.S. <br />~4 71.345).
