Mr. Brown replied the <br />access would be 20 feet, as well as the pond area. He stated the complicated part <br />here was the pond being on three different properties. <br /> <br />Council Member Aplikowski asked if this would set a precedence, Mr. Brown <br />replied recently they had been making these types of properties public easements, <br />and it was the City's intent to continue to make these types of properties public <br />domain. <br /> <br />Council Member Grant asked how much of the ponding area would be cleaned <br />out. Mr. Brown responded that most of it would be right around the outlet. He <br />stated it would be easier to work around the edge with the equipment. He indicated <br />this would be funded from the Stormwater Utility Fund_ He stated the homeowner <br />would not be able to plant trees or put any permanent type of structure on the <br />easement, which would restrict City equipment from reaching and maintaining the <br />pond. <br /> <br />Council Member Larson stated at a minimum they needed an easement for access, . <br />but ideally they wanted an easement to cover the entire pond area. <br /> <br />MOTION: Council Member Larson moved and Council Member Aplikowski <br />seconded a motion to authorize reclamation of a portion of the pond <br />adjacent to the outlet, and at the same time seek to acquire a drainage <br />easement for the entire pond, or at a minimum, that portion of the <br />pond accessible from Hunters Court that would allow access to the <br />pond.
