<br />Memo to Planning Commission <br />Planning Case #02-15 <br />Fred and Sylvia Bemdt Special Use Permit Amendment <br />Page 3 of4 <br /> <br />. <br /> <br />Deadline for Aqency Actions <br /> <br />The City of Arden Hills received the completed application for this request on <br />June 12, 2002. Pursuant to Minnesota State Statue, the City must act on this <br />request by August 11, 2002 (60 days), unless the City provides the petitioner with <br />written reasons for an additional 60 day review period. The City may with the <br />petitioners consent extend the review period beyond the 120 days. <br /> <br />Options <br /> <br />1. Recommend approval as submitted. <br />2. Recommend approval with conditions. <br />3. Recommend denial. If the City denies the petitioners request, "...it must <br />state in writing the reasons for the denial at the time that it denies the <br />request". <br />4. Table for additional information. <br /> <br />Staff Recommendation <br /> <br />To my knowledge, the City has not processed a Special Use Permit for this type . <br />of structure. As such, staff has outlined general options for approval or denial of <br />the application as opposed to providing a formal recommendation. <br /> <br />Approval of the Special Use Permit <br /> <br />A simple motion to approve the Special Use Permit based on the plans submitted <br />would be sufficient. <br /> <br />Denial of the Special Use Permit <br /> <br />If the Commission were inclined to deny the proposal, it would be necessary to <br />establish findings. Sample findings are included below: <br /> <br />1. The proposed boathouse does not further the purpose and intent of <br />Zoning Ordinance Section 1 (B) (2) "to promote the character of and <br />preserve and enhance the properties and areas within the city including <br />wetlands, ponds and marshes. <br />2. The proposed boathouse does not further the purpose and intent of <br />Zoning Ordinance Section 1 (B) (6) "to promote the proper use of land and <br />structures." <br />3. The proposed boathouse does not further the purpose and intent of <br />Zoning Ordinance Section 1 (B) (8) "to prohibit the use of buildings, . <br />structures, and lands that are incompatible with the intended use or <br />development of lands within the specified zones. <br />
