Since the waterproofing system <br />was not originally installed correctly, the City is not responsible for payment of the labor to excavate <br />and repair the waterproofing. However, the City does recognize that it did receive added value for the <br />sand backfill, new drain tile and re-spread on site of the excavated material. Rochon will have to seek <br />contribution from its subcontractors for the remainder of the costs associated with the waterproofing <br />repair. Accordingly the City will pay Rochon for the documented cost of the sand, drain tile and re- <br />spread of material. I understand that Architectural Alliance requested that back-up documentation for <br />these costs back in December of 200 I and again on August 2, 2002. Please provide that information as <br />soon as possible. <br /> <br />As you may know the City has grown frustrated with the lack of progress on the project <br />punchlists and several items remain incomplete. I understand that Architecmral Alliance has already <br />sent a letter to Rochon listing all oCthe items that require action. Addition.aIly, the City requires <br />reimbursement for the damages caused when water leaked into the basement on July 8, 2002. I have <br />attached a copy of the letter from Mike Munson dated July 22. 2002 substantiating the losses sustained. <br />If payment is not received by September 1,2002, the amount of $1 ,457.50 will be deducted from the <br />reuunage. <br /> <br />The City requires written confirmation that Rochon will complete the following !asks by <br />September I, 2002: <br /> <br />1. All landscaping work; <br />2. All mechanical punchlist items, including resolution of the balancing and temperature <br />control issues; <br />3.
