<br />Appendix A <br /> <br />l <br /> <br />Section 370 - Fireworks <br /> <br />. <br /> <br />370.01 Definitions. For purposes ofthis regulation. the foIlowing terms shaIl mean: <br /> <br />Subd. 1 "Fireworks" means any substance or combination of substances or article prepared <br />for the purpose of producing a vi8ible or an audible effect by combustion, explosion, <br />deflagration or detonation, and includes blank cartridges, toy cannons and toy canes in which <br />explosives are used, any type ofbaIloon which requires fire underneath to propel it, <br />firecrackers, torpedoes, skyrockets, Roman candles, daygo bombs, or other fireworks of like <br />construction, and any fireworks containing any explosive or inflanmIable compound, or any <br />tablet or other device containing any explosive substance and commonly used as fireworks. <br /> <br />Subd. 2 "Consumer fireworks" means toy pistol, toy guns, in which paper caps containing <br />0.25 grains or less of explosive compound are used and toy pistol caps which contain less <br />than 0.20 grains of explosive mixture as weIl as wire or wood sparklers of not more than 100 <br />granrs of mixture per item, other than sparkling items which are nonexplosive and nonaerial <br />and contain less than 75 granrs or less of chemical mixture per tube or a total of 200 granrs or <br />less for multiple tubes, snakes or glowworms, smoke devises, or trick noisemakers which <br />include paper streamers, party poppers, string poppers, snappers, and drop pops, each <br />consisting of not more than twenty-five hundredth grains of explosive mixture. The use of <br />consumer fireworks is not permitted on public property. This paragraph does not authorize <br />the purchase of consumer fireworks by persons younger than 18 years of age. <br /> <br />. <br /> <br />370.02 Permit or License Required. <br /> <br />Subd. 1 Fireworks. No person shaIl use or display any fireworks, except as provided herein. <br />Supervised public displays of fireworks by City, fair associations, anrusement parks and <br />other organizations other than the City and fair associations must obtain a permit for such <br />public displays. Such permits shall aIlow the use and display of fireworks for that display <br />only. No permit so granted shall be transferable. <br /> <br />A. Application. The application shall state the name and address of the person who <br />will supervise the display, the nanre and address of the person who will conduct <br />the display, the location of the display, and the date and time of the display. <br /> <br />B. Investigation. The Fire Chief shall investigate each application to determine <br />whether the operator ofthe display is competent and whether the display will be <br />of such a character or will be so located, discharged, or fired as to be hazardous to <br />any person or property. <br /> <br />C. Conditions. Every display shall be conducted so as not to endanger any person <br />or property. Every display shall be conducted in accordance with all applicable <br />provisions of this code, state law, and regulations including regulations of the <br />State Fire Marshall. <br /> <br />. <br />
