Are the circumstances for which the variance is requested unique to the property? <br /> <br />No. Putting the garage 10 feet from the property line will cause us to lose the use <br />of 1/2 of our back yard and make us relocate our existing driveway. This is true of <br />all of the ndghbors on our street as well as the surrounding streets. <br /> <br />2. Would granted the variance be in keeping with the spirit and intent of the City's <br /> <br />Yes. If our garage was attached we could be 5 feet from the property line. Our <br />original garage was 3 feet from the property line which most of the garages in the <br />neighborhood are. <br /> <br />3. Could the property in question be put to a reasonable use without the granting of the <br />variance? <br /> <br />No. We would have to rebuild the garage in the middle of our back yard which <br />would result in making the garage out of proportion to our house. This will also <br />cause our driveway to be at a odd angle. This could affect the resale value of our <br />house as well as the whole look of the neighborhood. <br /> <br />4. Was the hardship created by the owner? <br /> <br />No. The garage and a portion of our house was destroyed by a fire. The orginal <br />garage was 3 feet from the property line. <br /> <br />5. Would granting the variance alter the essential character of the neighborhood? <br /> <br />No. Not granting the variance would alter the character of the neighborhood as <br />the garage would be out of proportion to the neighbors as most of the garages are <br />3 feet from the property line not 10 feet. <br />
