Setbacks - Does not meet requirement. <br /> <br />The side yard interior minimum setback for accessory buildings in the R-2 district is lO <br />feet. The applicant's garage was sited at approximately 5 feet from the west property line <br />before it was destroyed. Lot Coverage - Exceeds Code Requirement. <br /> <br />The requirement for all residential districts is a maximum of 25%. The house and garage . <br />in relation to the property would constitute 12% lot coverage. <br /> <br />3. Landscape Lot Area - Exceeds Code Requirement. <br /> <br />The requirement for all residential districts is a Minimum Landscape Lot Area of 65%. <br />Construction of the garage would leave approximately 78% ofthe lot as landscape area. <br /> <br />Variance Criteria <br /> <br />Building permit #2036 for a detached garage was approved by the City Building <br />Inspector on August 22, 1950. Recently, the garage was destroyed by fire and the current <br />property owner hired a contractor to demolish the destroyed garage and rebuild it. A <br />demolition permit was granted by the Building Inspector on September 3, 2002. <br />However, the applicant was unaware that a new garage would be rcquired to meet the <br />current setbacks in the Zoning Code due to the garage being a non-conforming building <br />and that the garage was damaged by more than 50% so it could not be repaired. The <br />applicant is seeking a variance to locate a new garage in approximately the same location <br />as the one that was destroyed. <br /> <br />A. State Requirements <br /> <br />. <br />
