J'~-.:? f" <br /> <br />RESOLUTION APPROVING APPRAISAL VALUE OF <br />CITY'S TAKING OF PERMANENT ROADWAY AND <br />UTILITY EASEMENT AND TEMPORARY SLOPE EASEMENT <br />FROM GEORGE J. REILING <br /> <br />WHEREAS, the City of Arden Hills (the "City") commissioned <br />Davis & Lagerman, Inc. ("Davis") to render an appraisal report as <br />to the amount of damages which will be sustained by George J. <br />Reiling as a result of the City's taking from him of a permanent <br />roadway and utility easement and temporary slope easement over <br />and across the South 80 feet of the East 816 feet of the tract of <br />land which he owns (the "Reiling Tract") in the City that is <br />bounded by State Trunk Highway 96 on the north, Townhouse <br />Villages at Arden Hills on the east, the proposed Royal Hills <br />North Subdivision and the McClung Additions on the south, and <br />Snelling Avenue North on the west, and <br /> <br />WHEREAS, Davis has performed its appraisal and has issued <br />its report (the "Davis Appraisal Report"), dated August 28, 1984, <br />which determines that the damages which will be sustained by the <br />Reiling Tract as a result of the taking will be $11,000.00, and <br /> <br />WHEREAS, Section 117.042 of Minnesota Statutes, as <br />amended, provides that before the City may take title and <br />possession of the permanent roadway and utility easement and the <br />temporary slope easement, it must deposit with the Ramsey County <br />District Court an amount equal to the City's "approved appraisal <br />of value", and <br /> <br />WHEREAS, the City desires to take title and possession of <br />the easements in accordance with the requirements of Section <br />117.042 of Minnesota Statutes, as amended, <br /> <br />. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of <br />~he City, acting by unanimous vote of its members, hereby adopts <br />the Davis Appraisal Report, which estimates the value of damages <br />to be sustained by the Reiling Tract as a result of the condemna- <br />tion to be $11,000.00, as the City's approved appraisal of value. <br /> <br />BE IT FURTHER RESOLVED, that the Clerk-Administrator of <br />the City is authorized and directed to furnish certified copies <br />
