<br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br />RESOLUTION NO. 85-51 <br />RESOLUTION AGREEING TO GIVE PASSIVE APPROVAL <br />TO AN INCREASE IN BASIC CABLE TELEVISION SERVICE RATES <br />BY GROUP W CABLE OF THE NORTH SUBURBS, INC. <br /> <br />. <br /> <br />WHEREAS, pursuant to City Ordinance No. 226, Group <br />W Cable of the North Suburbs, Inc. ("Group W") has been granted <br />a non-exclusive revocable franchise to operate, construct, <br />and maintain a cable television system within the City; and <br /> <br />WHEREAS, the franchise agreement in effect provides <br />for the regulation of Basic Service rates by City; and <br /> <br />WHEREAS, the franchise agreement provides for a <br />passive rate review procedure to increase Basic Service rates <br />wherein Group W must give written notice of a proposed increase <br />to the City and the North Suburban Cable Conunission ("Conunission") <br />ninety (90) days prior to the effective date of the increase and <br />each proposed rate increase is automatically approved by City <br />unless expressly disapproved within ninety (90) days by <br />resolution of the Council; and <br /> <br />WHEREAS, Group W has given written notice on August <br />22, 1985 to the Conunission of a proposed increase in Basic <br />Service Rates from $7.95 to $9.95 per month, and <br /> <br />WHEREAS, Group W further requested authorization <br />to implement the proposed rate increase inunediately rather <br />than in ninety (90) days; and <br /> <br />WHEREAS, the Conunission reconunends to City that no <br />action be taken to disapprove the increase in Basic Service <br />rates and that Group W be permitted to implement the proposed <br />rate increase inunediately; <br /> <br />THEREFORE, BE IT RESOLVED, that the City Council <br />of the City of Arden Hills accepts the reconunendation of the <br />Conunission that no affirmative action be taken by the Council <br />to disapprove the proposed increase in Basic Service rates from <br />$7.95 to $9.95 per month under the terms of the franchise agree- <br />ment; <br /> <br />BE IT FURTHER RESOLVED, that all other provisions <br />contained in the franchise agreement shall remain in full force <br />and effect. <br /> <br />. <br /> <br />The above listed resolution was moved by Council- <br />member Thomas Sather and duly seconded by Councilmember Gary Peck. <br /> <br />The following members voted in the affirmative: <br />Robert Woodpurn, Thomas Sather, Gary Peck, and Nancy Hansen. <br /> <br />The following members voted in the negative: None. <br />The above resolution was duly adopted September 30, <br /> <br />1985. <br /> <br />ATTEST: <br /> <br />BY: <br /> <br />~Ldli ~~ <br /> <br />Charlotte McNiesh <br />Clerk-Administrator <br /> <br />~~ <br />'Ro ert L.
