CITY OF ARDEN HILLS RESOLUTION NO. 85-43 A RESOLUTION INDEMNIFYING THE STATE OF MINNESOTA FROM ANY LIABILITY WITH RESPECT TO IMPROVEMENT PROJECT P-85-1--PHASE ONE (MSA I.D. NO. S.A.P. 187-102-01) WHEREAS, Hamline Avenue North in the City of Arden Hills is part of the Municipal State Aid System (the "State Aid System"), and WHEREAS, the City of Arden Hills (the "City") has applied to the State of Minnesota Department of Transportation (the "State") for municipal aid to finance the improvements contemplated by the City's Improvement P-85-l--Phase One which is identified for purposes of the State Aid System as Project No. S.A.P. 187-102-01, hereinafter called "Phase One", and WHEREAS, Phase One is an "interim plan" for the improve- ment of Hamline Avenue and does not propose to upgrade Ham1ine Avenue to the standards and specifications of the State Aid System, and WHEREAS, the State will not provide financial assistance to the City unless the City indemnifies the State from any liability which may arise out of Hamline Avenue's still being a substandard road at the completion of the Phase One improvements, and WHEREAS, the City Council of the City is agreeable to indemnifying the State so long as the indemnification expires upon the City's completing such improvements to Hamline Avenue between Floral Drive and State Trunk Highway 96 as will bring it into compliance with State Aid System standards, . NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City that the City hereby agrees to indemnify, hold harmless and defend the State from any and all liability which may accrue with respect to that portion of Hamline Avenue lying between Floral Drive and State Trunk Highway 96 from the date hereof until that date on which the City has upgraded such section of Ham1ine Avenue to State Aid System standards whereupon such indemnification shall expire and be of no further force and effect.
