<br />.. <br /> <br />. <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION NO. 90-45 <br /> <br />RESOLUTION AUTHORIZING CONDEMNATION OF STORM <br />WATER EASEMENT AND PONDING AREA <br /> <br />WHEREAS, the City of Arden Hills has adopted a North Central Storm <br />Water Drainage Study which identifies areas to be included in a <br />central drainage system; and <br /> <br />WHEREAS, a storm water drainage pond has been dedicated to the City <br />as part of the Keithson Addition (herein "Keithson pond"); and <br /> <br />WHEREAS, Kei thson Pond is one of several ponds in the North Central <br />Drainage System and requires an outlet to be fully functional; and <br /> <br />WHEREAS, the North Central Drainage Study identifies an outlet for <br />Kei thson Pond flowing southerly and southwesterly to a larger <br />depression and natural ponding area on property owned by George <br />Reiling (herein "Reiling Pond"); and <br /> <br />WHEREAS, the City Council has determined that it is in the public's <br />interest to acquire and improve the ponding areas and rangeways <br />identified on the North Central Drainage Study. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Arden Hills City Council that <br />the City Administrator, in conjunction with the City's consultants, <br />is directed to obtain legal descriptions for the boundaries of the <br />proposed drainage and ponding easements on the Reiling property and <br />to obtain an estimate of the value of the easements to be acquired; <br />and <br /> <br />BE IT FURTHER RESOLVED, that the City Administrator, in conjunction <br />with the City Attorney, is directed to obtain the required easement <br />and ponding areas by negotiation with the affected property owner; <br />and <br /> <br />BE IT FURTHER RESOLVED, that in the event that such easements and <br />ponding areas can not be acquired through negotiation wi thin a <br />reasonable amount of time, the City Attorney is hereby authorized <br />to commence condemnation proceedings in order to acquire such <br />easements and ponding areas. <br /> <br />Adoption Date. <br />Hills the 10th <br /> <br />Passed by the City Council of the City of Arden <br />of np.cp.mhp.y , 1990. <br /> <br />J!a~Mr -;)""24"2-"'7<-) <br />Thomas Sather, Mayor <br /> <br />ATTEST: <br /> <br /> <br />Gary~~gq~ministrator <br />
