<br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION NO. 88-..1!Q. <br /> <br />A Resolution Vacating a Portion of Utility and Drainage Easements Located <br />on Lot 9, Block 1, Karth Lake South Addition (1295 Wyncrest Court) <br /> <br />WHEREAS, the owners of Lot 9, Block 1, Karth Lake South Addition (the <br />"Lot"), the Jacobsens, desire that the CITY OF ARDEN HILLS (the "City") <br />vacate a portion of the drainage and utility easement which runs over and <br />across the North 25 feet of the Lot (the "Easement Area") so as to allow them <br />to construct a garage thereon, and <br /> <br />W-lIEREAS, the City Engineer has advised the Council that he sees no <br />reasons why the City should not vacate the South 15 feet of the Easement <br />Area except that part thereof which lies between the Easterly line of the <br />Easement Area and a line which is 10 feet Westerly thereof and parallel <br />thereto (the"Garage Strip") and therefore recommends that the City vacate <br />the Garage Strip, and <br /> <br />WHEREAS, the Rice Creek Watershed District has indicated in a letter <br />to the City, dated October 7,1988, that it has no authority over the Easement <br />Area since the easement was not granted to it, and <br /> <br />. WHEREAS, although two weeks' published and posted notice has been <br />provided in accordance with the requirements of Section 412.851 of <br />Minnesota Statutes (the "Vacation Statute"), and in addition written notice <br />has been mailed to property owners owning properties within a 350 foot <br />radius of the Lot, no one has stated any objections to the vacation of the <br />Garage Strip either in writing or verbally, and <br /> <br />WHEREAS, it thus appears to be in the public interest to vacate the <br />Garage Strip, <br /> <br />NOW, THEREFORE, BE rr HEREBY RESOLVED by the City Council of <br />the City that the Garage Strip be vacated. <br /> <br />BE IT FURTHER RESOLVED, that the Administrator of the City be <br />authorized and directed to execute a Notice of Completion of Vacation <br />Proceeding, present it to the Ramsey County Auditor for entry in the <br />Transfer Record, and then record it in the office of the Ramsey County <br />Recorder in order to comply with the requirements of the Vacation Statute. <br /> <br />Passed by the City Council of the City this 12th day of December, 1988. <br /> <br />. <br /> <br />G~~ge~ni~tratA>r <br /> <br />-,' ,.', <br /> <br />.'...... ...~.f~,>./ <br /> <br />Robert Woodburn, Mayor <br />
