<br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION NO. 88-25 <br /> <br />A RESOLUTION APPROVING LOT SPLIT OF C. G. REIN DEVELOPMENT PARCEL <br />FOR TAX PURPOSES ONLY <br /> <br />WHEREAS, C. G. REIN COMPANY ("Rein"), a Minnesota corporation, is developing a parcel of <br />land (the "Development Parcel") located at 3751 Lexington Avenue North with an automobile <br />service center and a fast food restaurant, special use permits for which the City Council of the <br />City of Arden Hills (the "City") has granted Rein in connection with the City's Planning <br />Commission Case Nos. 88-14 and 88-15 respectively, and <br /> <br />. <br /> <br />WHEREAS, Rein has requested that the City divide the Development Parcel for tax purposes, <br />and those purposes only, because two separate and distinct projects are being constructed on the <br />Development Parcel, each of the projects will be operated by a separate entity (i.e, Goodyear and <br />Burger King) pursuant to a triple net lease which requires the lessee, among other things, to <br />defray taxes assessed to its project (i,e., its portion of the Development Parcel), and <br /> <br />WHEREAS, it would be in the best interests of the City and its citizens for the City's Council to <br />grant Rein's request, <br /> <br />NOW, THEREFmE, BE IT HEREBY RE5a..VED by the City Council of the City that the <br />Development Parcel be sp11t for tax purposes, and those purposes only, into two parcels-- Tax <br />Parcels 1 and 2--the legal descriptions of which are set forth on Exhibits "A" and "B" attached <br />hereto and made a part hereof. <br /> <br />BE IT FURTHER RE5a..VED, that the Clerk-Administrator of the City be authorized and directed <br />to furnish certified copies of this Resolution to the Ramsey County Director of Taxation and/or <br />Assessor's office and to Rein, <br /> <br />Passed by the City Council of the City this 25th day of July, 1988, <br /> <br />Attest: <br /> <br />. <br /> <br />/~R~ <br /> <br />GIIry R.
