<br />. <br /> <br />. <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION 97-27 <br /> <br />RESOLUTION ACCEPTING QUIT CLAIM DEED FOR VARIOUS <br />PORTIONS OF EXCESS MINNESOTA DEPARTMENT OF TRANSPORTATION <br />RIGHT'S-OF-WAY ADJACENT TO STH #51 <br /> <br />WHEREAS, Bethel College in Plarming Case 95-18 requested the City's assistance in obtaining <br />ownership from the Minnesota Department of Transportation to the Hamline Avenue Service <br />Road in front of their campus; and <br /> <br />WHEREAS, the City Council on August 14, 1995 concurred with Bethel College's request; and <br /> <br />WHEREAS, the Minnesota Department of Transportation has reviewed the entire right-of-way <br />to determine the extent of the excess right-of-way; <br /> <br />WHEREAS, the Minnesota Department of Transportation has determined that: the portion <br />requested by Bethel College, via the City, is excess right-of-way; Ham1ine Avenue, north of <br />County Road E and south of the railroad tracks is excess right-of-way; and the frontage road <br />which connects Grey Fox Road and Red Fox Road is also excess right-of-way; and <br /> <br />WHEREAS, the Minnesota Department of Transportation has forwarded a Quit Claim Deed <br />which transfers ownership ofthese parcels to the City of Arden Hills; and <br /> <br />WHEREAS, the City of Arden Hills intends to transfer ownership ofthe Hamline Avenue <br />Service Road, north of the railroad tracks to Bethel College, per their request; and <br /> <br />WHEREAS, the City of Arden Hills accepts Hamline Avenue, north of County Road E and <br />south of the railroad tracks and the frontage road which connects Grey Fox Road and Red Fox <br />Road, based on the fact that these roadways have been historically been maintained and operated <br />by the City of Arden Hills. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, <br />Minnesota that it accepts the Quit Claim Deed from the Minnesota Department of Transportation <br />for various portions of excess right's-of-way adjacent to State Highway #51. <br /> <br />U iLV~i~n <br />
