<br />. <br /> <br />e <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION NO. 96-45 <br /> <br />A RESOLUTION AUTHORIZING CONDEMNATION OF STREET, UTILITY AND <br />DRAINAGE EASEMENTS IN CONNECTION WITH OAK AVENUE <br />RECONSTRUCTION <br /> <br />WHEREAS,the City has awarded a contract for the reconstruction of Oak Avenue <br />(herein the "Project"); and <br /> <br />WHEREAS, in order to construct the Project as designed, it will be necessary to acquire <br />an easement over certain property owned by Marjorie E. Ashbach (herein the "Ashbach <br />Property"), as described on Exhibit A attached; and <br /> <br />WHEREAS,in order to construct the Project, it will be necessary to acquire an easement <br />over property owned by Richard L. And Janet E. Shepley (herein the "Shepley Property"), as <br />described on Exhibit B attached); and <br /> <br />WHEREAS, to date, negotiations to acquire the easements over the Ashbach and <br />Shepley parcels have been unsuccessful, <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the Arden Hills City Council hereby <br />authorizes the City Attorney to commence a condemnation proceeding to acquire the easements <br />over the Ashbach and Shepley properties described on Exhibits A and B attached, and <br /> <br />BE IT FURTHER RESOLVED, that the City Attorney is hereby directed to continue to <br />use all reasonable efforts to acquire such easements through negotiation provided that the <br />negotiations do not unreasonably delay the construction of the Project. <br /> <br />L OF THE CITY OF ARDEN <br />/ <br />// <br /> <br /> <br />PASSED AND ADOPTED BY THE CITY COUN <br />HILLS THIS 24TH DAY OF JUNE, 1996. <br /> <br />ATTEST: <br /> <br /> <br />R, CITY ADMINISTRATOR <br />
