<br />. <br /> <br />. <br /> <br />- <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION 96-61 <br /> <br />RESOLUTION VACATING A SANITARY SEWER EASEMENT <br /> <br />WHEREAS, the City of Arden Hills has been requested to vacate a portion of a 30 foot wide <br />sanitary sewer easement on a property in the Gateway Business District which is to be developed <br />pursuant to Planning Case 96-12, said easement being legally described as shown on Attachment <br />A; and <br /> <br />WHEREAS, the petition to vacate said easement was made by the affected property owners and <br />the City had caused a notice of public hearing to be published in the City's official newspaper for <br />two (2) consecutive weeks and the City has notified the affected property owner at least ten (10) <br />days prior to the public hearing; and <br /> <br />WHEREAS, the request to vacate was reviewed by the Planning Commission at a public hearing <br />on September 4, 1996 and approved by the City Council on September 30, 1996; and <br /> <br />WHEREAS, the City Council has determined that the identified portion of the easement <br />currently serves no public purpose, <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arden Hills, <br />Minnesota agrees to vacate said sanitary sewer easement, subject to the developer/applicant of <br />Planning Case #96-12 (Welsh Companies) constructing a new manhole at the end ofthe <br />remaining sanitary sewer line, <br /> <br />PASSED AND ADOPTED BY THE CITY COUNCIL O/THE CITY OF ARDEN HILLS <br />THIS 28TH DAY OF OCTOBER, 1996. . / <br /> <br /> <br /><,,'- <br /> <br />ATTEST: /' <br />/::-/ <br />L ,- <br /> <br /> <br />,CITY ADMINISTRATOR <br />
