<br />~. <br /> <br />.. <br /> <br />CITY OF ARDEN HILLS <br />RAMSEY COUNTY <br /> <br />RESOLUTION NO. 95-76 <br /> <br />RESOLUTION CONCURRING WITH RETROCEDING LEGISLATIVE <br />JURISDICTION OF THE ARMY RESERVE TRAINING CENTER <br /> <br />WHEREAS, the 88th RSC currently occupies property which is within the corporate <br />boundaries of the City and which is located in the Northwest Quadrant of the <br />intersection of Lexington Avenue and Highway 96; and <br /> <br />WHEREAS, the 88th RSC has formally requested the City to consider a change in jurisdiction <br />of the Army Reserve Site from an exclusive jurisdiction to a concurrent <br />jurisdiction; and <br /> <br />WHEREAS, the 88th RSC is conunitted to supporting the public activities of the City; and <br /> <br />WHEREAS, the parties desire to establish a longer term and closer working relationship with <br />each other in regards to the use and regulation of the Army Reserve Site; and <br /> <br />. WHEREAS, the Army Reserve site is currently included in an R-I Zoning District on the <br />City's Zoning Map and within an area designated as commercial on the City's <br />Comprehensive Plan Land Use map; and <br /> <br />WHEREAS, the parties recognize the existing Army Reserve site as a legal, nonconforming <br />use as defined under Section rx of the City's Zoning Ordinance; and <br /> <br />WHEREAS, the Army Reserve Site will be designated as a public use under Section II.D.113 <br />of the Arden Hills Zoning Ordinance upon the establishment of a concurrent <br />jurisdiction; and <br /> <br />WHEREAS, the parties recognize that should the 88th RSC change the facility and/or site plan <br />for the Army Reserve Site in the future, the 88th RSC will be required to comply <br />with the City's development regulations, including the application for a Special <br />Use Permit; and <br /> <br />WHEREAS, the parties have entered into an Memorandum of Agreement (MOA) and will <br />negotiate a long term license/outgrant agreement for use of the facility; and <br /> <br />WHEREAS, the City of Arden Hills at its September 25, 1995, Council Meeting, directed City <br />Staff to prepare the appropriate documentation to accept the retrocession request <br />subject to the terms of the MOA and licensing/outgrant agreement. <br /> <br />. <br />
